An Ontario court is being asked to quash an Integrity Commissioner’s report that led to a Fort Frances councillor resigning in May.
The report ruled David Kircher breached several sections of the Council Code of Conduct.
It recommended he face a suspension and make a public apology.
Kircher left the council meeting after the report was presented and before council accepted the recommended sanctions.
Kircher resigned his seat the next day.
In an application for a judicial review filed with the Ontario Superior Court of Justice on June 7th, Kircher alleges the Integrity Commissioner’s investigation was flawed and its decision to be unreasonable.
It alleged the Integrity Commissioner failed to provide Kircher with notice about the allegations made against him.
Kircher also claims the Integrity Commissioner improperly relied on incomplete and incorrect summaries of emails in coming to a decision.
A claim is also made that Kircher was not interviewed about the allegations against him but notes he did respond to questions emailed to him.
Mention is also made about council’s decision to accept the Integrity Commissioner’s report without questions or debate.
The allegations have not yet been proven in court.
