Legal action against Municipality of the County of Antigonish

Three Antigonish County residents appeared in Antigonish provincial court Friday, applying for a court order to quash special legislation adopted by County Council on October 20, 2022, to consolidate the Municipality and the Town of Antigonish.

In a press release from Let Antigonish Decide, the people are challenging County Council’s right to ask the provincial government to prepare ‘special consolidation legislation’ that would override legislation in the Municipal Government Act for the amalgamation.  The people of Antigonish want their say.

The Municipality says in a statement it is waiting for Justice Anthony Gabriel to make a decision. The matter was brought to the Supreme Court of Nova Scotia on Main St in Antigonish.

The press release says “the final outcome in this matter rests with our Premier, Tim Houston, and MLA’s Michelle Thompson, Greg Morrow and other members of the Houston government, the Warden, Mayor and all councillors. We hold them accountable to listen to their constituents.”

Meanwhile, County Council says it remains confident in its decision to request consolidation and looks forward to working with the town to move along the process.
