SIU clears officers after man hurt while in custody

No charges will be laid against officers after a man was hurt while in the custody of the Thunder Bay Police Service.

The Special Investigations Unit (SIU) announced the findings of its investigation into the incident on Friday.

A 42-year-old man was arrested on two outstanding warrants on Oct. 4 after police responded to a suspicious person call.

While at the police station during the intake process, the accused was seated on a metal bench in the booking room and coming down after ingesting fentanyl several hours earlier, according to the report.

“Both legs were bent at the knees and his arms and hands were wrapped around his legs. He was not handcuffed,” it said.

“At that time, he fell off the bench and onto the floor. There was no visible injury, and he was lodged in a holding cell without incident.”

Several hours later, the complainant was removed from his cell and brought before a justice, which was when he complained of pain in his left shoulder.

Paramedics were called and the man was taken to the Thunder Bay Regional Health Sciences Centre, where he was diagnosed with a broken left clavicle.

The SIU determined there were no reasonable grounds to believe that the subject officer committed a criminal offence in connection with the complainant’s arrest and injury.

“I accept that the complainant’s injury was the result of his fall from the booking bench to the ground. However, there was very little opportunity for the officers to process what was happening, much less to take any steps to prevent it,” said the report.

Investigators noted that while the man had almost fallen moments before, the officers had warned him to sit properly.
